CONDITIONS OF

BUSINESS FOR BUYERS

Introduction
In these Conditions of Business for Buyers, “we”, “us” and “our” refers to KVCF and “you” and “your” refer to Buyers. If you are an agent acting on behalf of a principal, “you” and “your” refer to both principal and agent.

Sale
This gem is offered for sale in the condition it is in at the time of the sale. Catalogue descriptions and certification reports are completed within two years and the condition of the gem has been properly stored and unchanged.

You accept responsibility for carrying out your own inspections and investigations of the gem in which you may be interested. You should inspect the gem before purchasing to determine and to satisfy yourself as to its condition, size and description. The gem may not leave our premises for further inspection; all additional inspections must occur with at least one member of KVCF present.

We reserve the right to withdraw the gem for sale at any time, up until money has been received in our account. Thus, if money is in transit and has not yet been received, the sale can be terminated.

The buyer is responsible for transportation and security of the gem to its final destination upon sale.

The gem will not leave the premises of KVCF possession until funds of sale have been received.

Only serious bids for sale will be considered. Payment is due in full in order for the stone to be released to You.

These Conditions of Business for Buyers are binding upon, and inures to the benefit of, you, your estate, heirs, executors, devisees, representatives, administrators, successors and permitted assigns.

This agreement will be governed by and construed in accordance with the laws of local governing authority. In the event of a dispute arising from or relating to this agreement, you agree to submit to the exclusive jurisdiction of the provincial courts of Alberta and the federal courts sitting in the province and country of Alberta, Canada, though we will retain the right to bring proceedings in a court other than the province and federal courts sitting in the province and country of Alberta, Canada.
